THEATRICAL STAGE EMPLOYEES UNION, Local No. 2 of the International Alliance of Theatrical Stage Employees and Moving Picture Machine Operators of the United States and Canada AFL-CIO rate conditions:
- RECOGNITION: The Employer agrees to and does hereby recognize the Union as the sole and exclusive bargaining agent for all Employees of Employer who perform work under the jurisdiction of the Union as hereinafter described.
- SCOPE AND JURISDICTION: In general, the scope of this agreement and jurisdiction of the Union shall extend to all carpentry, electrical, property, sound, and other related work recognized as traditionally falling within the jurisdiction of the Union, performed at the United Center, in connection with all theatrical/entertainment type productions, including " taking in" and " taking out," handling, assembling and dismantling of any and all equipment, including spotlights used in connection with any theatrical/entertainment type production, including rehearsals. Only Employees of the Employer covered hereby shall perform any for the work on theatrical/entertainment type productions that come within the jurisdiction of the Union as above described.
- PERFORMANCE DEFINED: Three (3) hours or less shall constitute a performance. A rehearsal shall be classified as performance and paid for as such.
- PACKING TIME: Whenever it is required to pack during showtime, the number of show men required shall be paid at the prevailing hourly rate for said packing time, in addition to the regular performance rate.
- MINIMUM CALLS: The following minimum calls shall be adhered to at all times:
- Calls made on days when no performance or rehearsal is scheduled shall be eight (8) hours.
- Calls made on day of performance or rehearsal shall be a minimum of four (4) consecutive hours which shall not terminate more than two (2) hours before the rehearsal of performance call.
- On day of performance or rehearsal, men may be called one (1) hour immediately prior to performance or rehearsal call.
- Calls for extra men to put on shows shall be a minimum of eight (8) hours at prevailing rate.
- Calls for extra men to take out shows shall be a minimum of four (4) hours at the overtime rate.
- Fractions of an hour will be computed as a whole hour and paid as such.
- OVERTIME RATES: The overtime rate shall be computed at twice the single-time rate, and paid under the following conditions:
- In excess of (8) hours per day.
- Between the hours of 12:00 midnight and 8:00 a.m.
- On Sundays, except for performances. Sunday performances shall be computed at one and one-half (1 1/2) the single-time rate.
- All holidays recognized as such in this agreement, (see paragraph 7).
- All extra men who take out shows, but do not work the performances.
- When lunch period is not granted after third hour of work, but in any event not later than the end of any five (5) hour interval, men will be paid one (1) hour double-time.
- If less than eight (8) hours elapses between the end of one shift and the beginning of the next call, all hours worked will be at the overtime rate until a rest period of eight (8) hours is given. Less than a break of four (4) hours shall be considered as time worked and employees shall be paid for said break period.
This clause applies when working on the same attraction and not change overs from one event to another, which will be treated as separate calls. - After forty (40) hours at single-time rate on same attraction.
- Employer may not replace men on job in order to avoid payment of higher rates; the same men must be kept on until the completion of the call.
- HOLIDAYS: Legal holidays, for the purpose of this agreement are listed below. Employees who work such holidays shall be paid the overtime rate for all hours worked.
- Holiday performances shall be paid as follows:
Double performance rate for:
New Year's Day, Memorial Day, Independence Day, Thanksgiving Day, Christmas Day.
One and one-half performance rate for:
President's Day, Veterans' Day, Election Day, Labor Day, Columbus Day.
Holidays shall be celebrated on the days designated by the State of Illinois.
- Holiday performances shall be paid as follows:
- YELLOW CARD SHOWS: The yellow card will be strictly adhered to and its full complement of men shall be employed at all times; taking in, putting on, rehearsing, working and taking out an attraction.
When working on yellow card shows, all men will confine their work to their respective departments. - ADMITTANCE OF BUSINESS AGENT: The Business Manager, or his representative, is to be admitted into the venue at all times to properly supervise conditions coming under the jurisdiction of the Union.
- SAFETY REQUIREMENTS: The Union has the right to demand that its members be surrounded with reasonable safeguards at all times while working and also that the Employer furnish proof of coverage under Employer's liability and workmen's compensation insurance.
- RADIO BROADCASTING:
- When the current booked attraction is taped or broadcast for professional use all men shall receive the performance rate in addition to any other form of compensation.
- A single broadcast, other than during a performance of the current booked attraction, shall employ the minimum house crew and whatever other men are necessary. The scale shall be the performance rate for three (3) hours and applicable hourly rate for hours in excess of three.
- TELEVISION: Television, videotape or other electronic processes of reproducing visual information from the stage, not including press releases for either live television or videotaped broadcast, etc., shall be governed by house scale and conditions.
- Closed circuit television, (which is shown at the venue, but is not broadcast on the air) shall be governed by house scale.
- If a booked attraction reproduced electronically, mechanically, or in any way videotaped , filmed, televised or recorded for basic free television, the entire crew will be compensated at the single-time rate based on forty (40) hours pay.
- If an attraction is reproduced electronically, mechanically, or in any way taped, videotaped, filmed, televised or recorded for basic cable, pay cable, pay television, video cassettes or video/laser discs, the management will notify the Union thereof, in writing one week in advance of the day in which such activity is to commence, and it is understood that all stagehands work shall be done exclusively by employees of management under and pursuant to the terms of this agreement, except that any additional compensation of special crew requirements and/or working conditions to apply shall be subject to negotiations between management and/or the Leaser and the Union.
- If a production is mounted for the sole purpose of recording for any of the markets outlined in section C the management will notify the Union to discuss working conditions, work assignments, compensation and/or fees to be paid.
- WORKING CONDITIONS: Employer agrees to maintain at all times proper sanitary conditions and adequate lockers for the protection of the stagehands' property. The employer shall make available to the stage crew a suitable room where they can change and hang their clothing.
- VACATIONS: The employer agrees to pay an amount equal to seven percent (7%) of total gross wages paid to each employee as vacation earnings. The vacation fund shall disburse to conform with present practices.
- RETIREMENT FUND: The employer hereby agrees to participate in the Union's retirement plan by contributing an amount equal to eight percent (8%) of total gross earnings paid to employees under the terms of this agreement. Monthly contributions are to be made payable to Pension Fund and mailed to the Union office at 20 N. Wacker Drive, Suite 1032, Chicago, Illinois 60606.
- HEALTH & WELFARE FUND: The Employer hereby agrees to contribute an amount equal to nine percent (9%) of total gross earnings paid to employees covered by this agreement, to Stagehands Local No. 2 Health & Welfare Fund. Contributions are to coincide with weekly payrolls and are to be mailed to the Union office at 20 N. Wacker Drive, Suite 1032, Chicago, Illinois 60606.
- ANNUITY PLANS: The Employer will participate in the Union's Annuity Plan and agrees to contribute an amount equal to eight percent (10%) of total gross wages paid to employees covered by this agreement. Payments, to coincide with weekly payrolls, are to be made payable to the Stagehands Local No. 2 Annuity Fund and mailed to the Union office at 20 N. Wacker Drive, Suite 1032, Chicago, Illinois 60606.
- INVALIDITY OF A PROVISION: The parties hereto attest that to the best of their knowledge and belief, this contract contains no provision which is contrary to federal or state law. Should, however, any provision of this agreement at any time during its life be held by a court of competent jurisdiction to be in conflict with federal or state law, then such provision shall continue in effect only to the extent permitted. In the event that any provision of this contract is thus held inoperative, the remaining provisions of this contract shall nevertheless remain in full force and effect.
- SUCCESSORS: This agreement shall be binding upon and inure to the benefits of the parties hereto, their successors and assigns.
- NON-DISCRIMINATION POLICY: The Employer and the Union agree not to discriminate against any Employee because of sex, creed, color, or national origin.
